Clause 9.1.2: Evaluation of compliance

Requirement todayISO 45001:2018Remote overlay: CompliancePublic scope

The organization sets up, runs and keeps processes for evaluating whether it complies with legal and other requirements.

What clause 9.1.2 asks

The organization sets up, runs and keeps processes for evaluating whether it complies with legal and other requirements. It decides how often and by what methods compliance is evaluated, carries out the evaluation and acts where needed, keeps up its knowledge and understanding of where it stands on compliance, and retains documented information on the results.

Evaluating compliance is a separate duty from monitoring performance. It asks whether each legal and other requirement is met, by what method, and what was done when it was not.

The remote working overlay

Evaluate compliance where the worker is. A remote worker may be covered by the law of the place they work, as well as the law of the employer's site. The public record does not state those duties. The compliance evaluation has to name the instrument for each remote group and test the operational duty, not only the permit or the policy. Local counsel decides the legal question; the system records the answer.

Basis: BSI Standards Development, ISO. For clause 9.1.2, the public record is a draft guideline and does not state a requirement in terms that this site can quote. The clause 9.1.2 overlay is our reading of the public scope and the named summaries, not the draft text.

Evidence for clause 9.1.2

An auditor will pick a requirement from the register and ask for the evaluation that tested it.

  • Compliance evaluation Compliance evaluation schedule and method
  • Compliance evaluation Compliance evaluation reports with status per requirement
  • Compliance evaluation Actions raised for non-compliances
  • Compliance evaluation Evidence the organization knows its current compliance status

Where clause 9.1.2 commonly fails

  • Compliance assumed rather than evaluated
  • Evaluation covers permits but not operational duties
  • No action taken on identified non-compliance

What to do about clause 9.1.2 before the guidance lands

Add the remote jurisdictions to the compliance schedule. Record the instrument, the duty, the method and the status for each group, and review the schedule when a worker moves. Keep the legal advice with the record.

For clause 9.1.2, do the work that will be right under either instrument. The current requirement for clause 9.1.2 is ISO 45001:2018, and the certificate, if you hold one, is issued against it. The clause 9.1.2 remote working preparation is an extension of the existing duty to a group of workers the system already covers, not a new system and not a reason to rebuild around a draft.
