Clause 6.1.3: Determination of legal requirements and other requirements
The organization sets up, runs and keeps processes that identify, and give it access to, current legal and other requirements relevant to its hazards, its OH&S risks and its OH&S management system; that establish how these requirements affect the organization and what must be communicated; and that make sure they are taken into account as the system is set up, run, kept and continually improved.
What clause 6.1.3 asks
The organization sets up, runs and keeps processes that identify, and give it access to, current legal and other requirements relevant to its hazards, its OH&S risks and its OH&S management system; that establish how these requirements affect the organization and what must be communicated; and that make sure they are taken into account as the system is set up, run, kept and continually improved. Documented information on legal and other requirements is kept, and it is updated whenever they change.
The register has to say how each requirement applies to this organization's hazards, not just that the instrument exists. Other requirements, such as customer clauses and union agreements, belong in the same list.
The law where the worker is, not only where the office is. A remote worker may live in a different state or country from the site that employs them. Health and safety, employment, working time, display screen and right-to-disconnect duties can follow the worker's location as well as the employer's. The public record does not state those duties and this site does not either; it names the need to record the applicable instrument for each remote group.
Basis: BSI Standards Development, ISO. For clause 6.1.3, the public record is a draft guideline and does not state a requirement in terms that this site can quote. The clause 6.1.3 overlay is our reading of the public scope and the named summaries, not the draft text.

What to do about clause 6.1.3 before the guidance lands
Add an applicability column to the legal register for each remote group and jurisdiction. Name the instrument and the duty that applies to the remote workplace, and review it when a worker moves or the arrangement changes. This is a record to check with local counsel, not a statement of law by this site.
For clause 6.1.3, do the work that will be right under either instrument. The current requirement for clause 6.1.3 is ISO 45001:2018, and the certificate, if you hold one, is issued against it. The clause 6.1.3 remote working preparation is an extension of the existing duty to a group of workers the system already covers, not a new system and not a reason to rebuild around a draft.
